Please read these Terms of Service ("Terms") carefully before using the Private Notes mobile application (the "App") operated by us ("we", "us", or "our").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the App.

1. Use of the App

1.1 License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

1.2 Restrictions
You agree not to:

  • Use the App for any illegal purpose or in violation of any laws

  • Attempt to reverse engineer, decompile, or disassemble the App

  • Remove, alter, or obscure any proprietary notices on the App

  • Use the App to transmit viruses, malware, or other harmful code

  • Use automated systems (bots, scripts) to access the App

  • Impersonate any person or entity or misrepresent your affiliation

2. AI-GENERATED CONTENT

2.1 Nature of Local AI Responses
The App uses on-device artificial intelligence (such as local Gemma models) to generate responses based on the notes and content you provide. You acknowledge that:

  • AI-generated content may not always be accurate, complete, or reliable

  • Responses are generated based on patterns in training data and your local embeddings, and may contain errors

  • You should verify important information from authoritative sources

  • AI responses do not constitute professional advice (legal, medical, financial, etc.)

2.2 No Liability for AI Content
We are not responsible for:

  • The accuracy, completeness, or reliability of AI-generated responses

  • Any decisions you make based on AI-generated content

  • Any harm or damages resulting from reliance on AI responses

3. VOICE FEATURES

3.1 Local Voice Processing
The App includes voice recognition and playback features that:

  • Process your voice commands and generate speech entirely on your device

  • Do not transmit your audio to remote servers or cloud services

  • Require microphone permissions to function

3.2 Voice Quality
Voice recognition accuracy may vary based on:

  • Audio quality and background noise

  • Accent, pronunciation, and speaking pace

  • Device microphone quality

4. USER CONTENT AND PRIVACY

4.1 Local Storage
Your notes, embeddings, and interactions are stored locally on your device. We do not have access to, nor do we host or back up, your personal content on our servers. You are solely responsible for securing your device and backing up your data independently.

4.2 Your Responsibility
You are solely responsible for:

  • All content you input or import into the App (text, voice, etc.)

  • Ensuring your content does not violate any laws or third-party rights

  • Any consequences resulting from your interactions with the App

4.3 Prohibited Content
You may not use the App to create or organize:

  • Illegal, harmful, threatening, or abusive content

  • Content that infringes intellectual property rights

  • Content intended to harass, intimidate, or harm others

  • Spam, malware, or fraudulent content

  • Content promoting violence, hatred, or discrimination

5. INTELLECTUAL PROPERTY

5.1 Our Rights
The App and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

5.2 Your Rights
You retain full ownership of any content you input or import into the App. Because all processing happens locally, we do not require or request a license to process, host, or transmit your input.

6. AVAILABILITY AND MODIFICATIONS

6.1 Service Availability
We strive to maintain the App's functionality but do not guarantee:

  • Error-free operation across all Android devices

  • That defects will be corrected immediately

  • That the App will support all future on-device model architectures

6.2 Modifications
We reserve the right to:

  • Modify or discontinue the App at any time without notice

  • Update these Terms at any time

  • Change features, functionality, or subscription pricing

7. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App

  • Any bugs, viruses, or other harmful code introduced to your device

  • Any errors or omissions in AI-generated content

  • Any data loss resulting from device failure, app deletion, or database corruption

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App or violation of these Terms.

10. AGE RESTRICTIONS

The App is not intended for use by individuals under the age of 13. By using the App, you represent that you are at least 13 years old.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

12. TERMINATION

We may terminate or suspend your license to use the App immediately, without prior notice or liability, for any reason, including breach of these Terms.
